PRE-CONTRACTUAL INFORMATION

The subject of the contract is the sale of products and/or the provision of services for the home by Enel Energia for domestic customers only. The type, characteristics and prices of the products and/or services are indicated in the specific Subscription Form, which we ask you to read carefully, together with the General Terms and Conditions.

 

1. About Us

Enel Energia S.p.a. with registered office at Via Luigi Boccherini 15, 00198 - Rome. The offer is made at physical points, through an Enel Energia sales representative, or via the web. The provisions of the Consumer Code (Legislative Decree 206/2005 as amended) relating to contracts concluded off-premises or by means of distance communication techniques apply to the contract.

 

2. Our contact channels

For further information and clarifications, you can contact Customer Services by calling the toll-free number (for both landlines and mobile phones) 800.900.860 operating from Monday to Friday from 8:30 a.m. to 8:00 p.m., go in person to Enel's physical Points of Sale, or surf the enel.it website yourself. Any complaints should be submitted in written form to P.O. Box number 8080 - 85100 Potenza (PZ), always indicating, clearly and correctly, the type and number of the reference contract.

 

3. How to subscribe to the offer. Cooling-off period

The Customer may subscribe to the offer through the following channels: Physical Points, Agencies, Smart Agents, both inside and outside commercial premises; membership takes place by indicating the chosen product/service on the Subscription Form and signing the appropriate signature fields.

The customer may also subscribe to the offer via the web or by telephone.

Should the Customer wish to exercise their right of withdrawal, they may do so, free of charge, within 14 days from the date of signing the contract in the case of contracts that include the provision of services, or 14 days from delivery of the product in the case of the sale of products only. Withdrawal is possible in the following ways: by sending written communication (using the standard form attached to the contract) by registered mail to Casella Postale 8080 - 85100 Potenza (PZ), or by sending an email (attaching the same form) to direzionecustomercare-enelx@enel.com, or by calling the toll-free number 800.900.860 (provided that the customer consents to the recording of the telephone call).

If the customer expressly so requests, the installation of the Products may be carried out from the date of delivery of same, i.e. within the 14-day period provided for application of the right of cooling-off period, in accordance with the terms of the Contract. In the event of the sale of Products, the customer shall return the purchased Products in the manner described in the Contract.

 

4. Fees, invoicing and payment methods

Invoices are issued in electronic format, as provided for in Art. 1 (909) of the Budget Law for 2018 (L. 27 December 2017, no. 205), according to the technical specifications approved by the provisions of the Director of the Revenue Agency, transmitted through the SdI (Sistema di Interscambio) and sent to the e-mail address indicated in the purchase and/or in the Subscription Form.

Payment of the fee may be made by direct debit from a bank account, postal account or credit card, or by financing with credit institutions, or in a lump sum by bank transfer or credit card, or, for customers with a contract for the supply of electricity and/or gas for domestic use with Enel Energia, by debiting their Enel Energia bill, in accordance with the procedures set out in the General Contract Conditions and the Subscription Form.

The customer shall make regular and full payment of the price indicated in the Subscription Form, in accordance with the terms set forth therein, no more than 30 (thirty) days from the issue of the invoice. In the event of non-payment within that period, the Contract shall be deemed automatically terminated and shall cease to have any effect.

 

5 Delivery/installation of the product or activation of the Service

The customer will receive the chosen Product at the address provided at the time of purchase, no later than 30 days after purchase in the case of products without installation. In the event of a delay in delivery, Enel Energia will notify the Customer, possibly indicating a new delivery date.

If the contract also provides for the installation of the Product by Enel Energia, this will commence within 90 days for Products pertaining to the HVAC category (Climate, Boiler, Water Heater), and within 180 days for Products pertaining to the Green Products category (Photovoltaic, Storage, Inverter, Solar Thermal). The timelines stated run from the completion of the last of the following activities, indicated in chronological order:

  • successful technical feasibility check;

  • payment by the Customer;

  • provision by the Customer to Enel Energia of the documentation necessary to prepare the project, to certify the ownership of the property and its regularity from an administrative point of view, as well as any other necessary authorisation, as better specified in the Contract;

  • completion of the authorisation procedures required for the installation of the Product.

In the event of a delay in the installation of the Product, Enel Energia will notify the Customer, possibly indicating the new deadline for installation.

In the case of offers concerning a service, this may only be requested after successful payment, which will determine the "Service Activation Date".

 

6. Legal and commercial guarantee and after-sales service

The Products are covered by a 24-month guarantee for conformity defects, as provided for in the Consumer Code and by the conventional manufacturers’ guarantees, provided in the manner described in the Contract.
